Terms of Service.
These terms are an agreement between The Small Apps (“we”, “us”) and the organisation that signs up for synkd (“you”, the “Customer”). By creating an account or using the service, you agree to them on behalf of your organisation, and you confirm that you are authorised to do so.
The service
synkd is an online service for attendance, leave, approvals, payroll, documents and related HR work, used through the web portal at hr.thesmallapps.com and the synkd mobile apps. Features available to you depend on your plan.
Mobile apps
Employees use the synkd apps with an account created by their employer. The apps are provided under these terms; if you download them from Google Play or the App Store, that store’s terms also apply to the download, but the store is not responsible for the service.
Accounts
- You are responsible for the people you invite, the roles you give them, and everything done under your organisation’s account.
- Keep passwords and authenticator codes confidential, and tell us promptly at hello@synkd.in if you suspect unauthorised access.
- You must provide accurate information and keep it up to date.
Plans, trial and fees
- Fees are charged per active employee per month at the rate of your plan, as shown on our pricing page or in your order. Prices are in Indian rupees and exclude GST and other applicable taxes, which are added to invoices.
- New organisations may get a free trial (currently 14 days). At the end of the trial, the account continues on a paid plan only if you choose one.
- Invoices are payable within 15 days unless agreed otherwise. If payment is overdue, we may suspend the account after giving notice.
- We may change prices with at least 30 days’ notice; changes apply from your next billing period.
Your data
You own the data you and your employees put into the service (“Customer Data”). You give us permission to host, process and display it only to provide, secure and support the service for you.
For personal data of your employees, you are the Data Fiduciary and we act as your Data Processor under the DPDP Act, as described in our Privacy Policy. You are responsible for having a lawful basis for that data and for giving your employees the notices the law requires. We will process it only on your instructions, keep it secure, and help you respond to your employees’ requests.
Payroll and statutory calculations
synkd calculates salaries, PF, ESI, professional tax and TDS from the salary structures, settings and tax rules configured in your account. You remain responsible for checking payroll before finalising it, for statutory payments and filings, and for the accuracy of the information you enter. The service helps you do this work; it is not legal, tax or accounting advice.
Acceptable use
- Do not use the service for anything unlawful, or to store data you have no right to process.
- Do not attempt to break, probe or overload the service, access other organisations’ data, or reverse-engineer it.
- Do not resell the service or let people outside your organisation use it, except your advisers acting for you.
Availability and support
We work to keep synkd available and secure, with regular backups, but we do not promise uninterrupted service. We may carry out planned maintenance, ideally outside Indian working hours, and will tell you in advance of significant downtime. Support is by e-mail at hello@synkd.in.
Changes to the service
We improve the service over time and may change or remove features. If we remove a material feature you pay for, we will tell you in advance and you may end your subscription.
Ending the agreement
- You may stop using the service at any time; fees already invoiced are not refundable.
- We may suspend or end an account for serious or repeated breach of these terms, or non-payment, after notice where reasonable.
- After an account ends, you can export your data for 30 days. We then delete Customer Data within 90 days, except what the law requires us to keep.
Liability
To the extent the law allows, neither party is liable for indirect or consequential losses, or for lost profits or data that could have been avoided by reasonable backups. Our total liability arising from these terms in any 12 months is limited to the fees you paid us for the service in those 12 months.
Nothing in these terms limits liability that cannot be limited by law.
Indemnity
You will compensate us for claims by third parties, including your employees, arising from Customer Data you had no right to process or from your breach of these terms.
Changes to these terms
We may update these terms. We will give at least 30 days’ notice of material changes by e-mail or in the service; continuing to use the service after that means you accept them.
Governing law
These terms are governed by the laws of India. The courts at [city] have exclusive jurisdiction over any dispute arising from them.
